Tafta Thailand-Australia Free Trade Agreement

The Chapter contains provisions on the anti-hostility treatment of investors of the other Party (with exceptions) and the protection of investments, including an agreement to expropriate the investments of investors of the other Party, except for public purposes, for non-discriminatory and compensated purposes. The presentation by the Australian Council of Trade Unions (ACTU) also raised a number of concerns, highlighted its preference for multilateral trade agreements in general and expressed disagreement, for example with the investor-state dispute settlement mechanism and the lack of labour standards. (43) The implementation of the Free Trade Agreement will also enhance Australia`s commercial, economic and security interests in the region. A substantial and comprehensive free trade agreement between the two countries will show strong support for multilateral, regional and bilateral initiatives, contribute to the creation of an open global and regional trading environment, and promote strength and stability in the region.14 In particular: highlights the continuing failure of the federal government to recognise a link between, on the one hand, the pursuit of trade liberalisation and, on the other hand, the many issues of sustainable development. This omission is of particular concern considering that the free trade agreement was negotiated with Thailand, a developing country with many environmental and social problems.169 The agreement contains a number of guarantees allowing for the temporary withdrawal of tariff preferences for certain products. there are two specific categories of safeguard measures under the Agreement: transitional safeguards which are available subject to proof of injury; 23 Bilateral issues cover quarantine issues concerning chicken meat, shrimp and tropical fruits, as evidenced by the priorities of Thais in the Quarantine Consultation Forum established in the Agreement (see Annex 6.1 to the Agreement). . . .
